§ 1
GENERAL RULES

  1. This Terms and Conditions defines the rules for the sale and redemption of Vouchers. The issuer of the Vouchers is JELENIA STRUGA MEDICAL SPA Sp. z o.o. Podgórze 55, 58-530 Kowary, registered in the business register in the National Court Register under number 0000284357 by the District Court in Wrocław, 9th Commercial Division of the National Court Register, VAT ID: 6112628600.
  2. The Buyer means a natural or legal person purchasing the Voucher from the Issuer.
  3. The Issuer offers the following types of vouchers:
    • Monetary Voucher,
    • Stay Voucher,
    • Voucher for cosmetic services.
  4. Each Voucher has its unique identification number.
  5. All Vouchers are recorded by the Issuer.
  6. The expiration date is indicated on the Voucher, standardly it is 3 months from the date of issue. The expiration date may differ from the standard if both parties, i.e., the issuer and the buyer, agree otherwise.

  7. The purchased stay voucher has an expiration date of 3 months from the date of purchase. The redemption of the voucher is subject to the current offer of the property at the time of booking. If the price of the stay according to the current price list or promotional offer is higher than the voucher value, redemption of the voucher may require the client to pay an additional amount corresponding to the price difference.

  8. The Voucher's expiration date is not extendable. Vouchers may have restrictions on availability during certain periods such as "long weekends", Christmas holidays, New Year's Eve, New Year, Easter holidays. A long weekend refers to a weekend when a day directly adjacent to Saturday and Sunday is also a day off, usually due to it being a public holiday.
  9. Upon receiving the Voucher, the Buyer declares that they have read the Terms and Conditions, fully accept its provisions, and undertake to comply with it.
  10. The Voucher can be purchased from the Issuer either directly or via remote communication means based on a prior order, as specified in § 3.

§ 2
RULES OF USE

  1. The Issuer is not responsible for loss or damage of the Voucher from the date it is handed over to the Buyer.
  2. The Buyer is obligated to make a prior reservation for the stay or service at least 7 days in advance. The condition to perform the service by the Issuer is the prior presentation of the Voucher or providing the Voucher number.
  3. The Buyer is not entitled to receive change if the full value of the Voucher is not used.
  4. If the price of the service exceeds the Voucher's value, the Buyer or Voucher holder must pay the difference.
  5. The Issuer has the right to request the Buyer to send a scan/photo of the Voucher for document verification.
  6. The Issuer has the right to refuse to redeem a Voucher in the following cases:
    • expiration of the Voucher validity period,
    • damage to the Voucher preventing reading of the individual identification number,
    • failure to make a prior reservation as per item 2.

§ 3
PURCHASE OF VOUCHER BY CONSUMER REMOTELY

  1. If the Buyer expresses the intention to conclude a distance contract for the purchase of a Voucher, the Issuer informs the Buyer about the total amount the Voucher will be issued for and the type of related services.
  2. The Issuer will deliver the Voucher to the address provided by the Buyer.
  3. The process of delivering the Voucher to the Buyer begins upon receipt of a payment equal to the Voucher's value.

§ 4
COMPLAINTS

  1. Every Buyer has the right to file a complaint within 14 days from the date of receiving the Voucher. The complaint should be submitted in writing or to the Issuer's email address. The Issuer or Partner Facility will consider the complaint within 14 days from receipt and notify about its resolution.
  2. The written complaint should include the name, surname, phone number, email address, clear signature of the Buyer, as well as a detailed description and reason for the complaint. Incomplete complaints or those submitted after the deadline will not be considered.
  3. The Buyer or Voucher holder will be informed about the complaint outcome.

§ 5
SETTLEMENT

  1. Payment for Vouchers purchased from the Issuer can be made online at www.jeleniastruga.pl – exclusively for Monetary Vouchers.
  2. Payment for Vouchers purchased from the Issuer can also be made by bank transfer to an account previously indicated by the Issuer, in cash, or by card upon collection of the Voucher at the Issuer's registered office, applicable for Stay Vouchers or Vouchers for cosmetic services.
  3. The confirmation of a Voucher purchase is a VAT invoice for the service "other 23%."
  4. The Issuer delivers Vouchers via a courier company. Delivery cost within Poland depends on the payment method and delivery type. Delivery of ordered Vouchers is made within the territory of the Republic of Poland.
  5. Before redeeming the Voucher, the Issuer performs verification each time.

§ 6
FINAL PROVISIONS

  1. In matters not regulated by these Terms and Conditions, the relevant provisions of generally applicable law shall apply.
